Terms and Conditions for Dash Cam Footage Submission

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS PLATFORM. ACCESSING OR USING THIS PLATFORM INDICATES THAT YOU ACCEPT THE TERMS AND CONDITIONS SET FORTH HEREIN BELOW ("TERMS"). IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE PLATFORM.
These Terms govern your submission of dash camera footage (“Footage”) to MiTAC Australia Pty Ltd. (“MiTAC”, “we”, “our”, “us”).
MiTAC may update or amend these Terms from time to time. The revised Terms take effect from the date they are published on the upload page, and your continued submission or use of the Platform after such changes constitutes acceptance of the updated Terms.
- Definitions
In these Terms:
- “User”, “you”, “your” means the individual uploading or submitting the Footage.
- “Footage” means dash camera video, images, audio, metadata, or any related content submitted by you.
- “Platform” means the webpage, upload portal, QR-code landing page, or system used for Footage submission.
- “MiTAC” means MiTAC Australia Pty Ltd.
- Voluntary Submission and Eligibility
- Submission of Footage is entirely voluntary.
- By submitting Footage, you confirm that you have full legal capacity and authority to enter into these Terms and submit/upload the Footage.
- You must be at least 18 years old to submit Footage.
- Ownership of Footage
You remain the sole owner of the Footage. Nothing in these Terms transfers ownership of the Footage to MiTAC. However, by submitting Footage, you grant MiTAC the license described in Article 4.
- License Granted to MiTAC
By uploading the Footage, you grant MiTAC a perpetual, worldwide, royalty-free, irrevocable, non-exclusive, and transferable license and right to:
- use, reproduce, edit, store, modify, adapt, publish, license, publicly display, distribute, and create derivative works from the Footage;
- use the Footage for marketing, promotional, educational, and commercial purposes in Australia and New Zealand;
- combine, edit, copy the Footage with other content or materials.
This license includes, without limitation of, the right to publish the Footage on:
- MiTAC websites
- social media accounts
- digital and print marketing materials
- media/press communications
MiTAC has no obligation to use or publish any Footage submitted. You are aware that MiTAC has no duty to monitor the user submitted comments or other use submissions.
- User Warranties
By submitting Footage, you confirm, represent and warrant that:
- You are the creator or lawful owner of the Footage.
- You have all necessary rights to grant the license in Article 4.
- The Footage does not and will not infringe or violates any right of a third party including, but not limited to copyright, patent, trademark, trade secret or other proprietary or contractual rights, right of privacy or publicity, or any confidentiality obligation. You will be solely liable for any damage resulting from any infringement of the above rights or any other harm resulting from your submissions.
- Any third parties appearing in the Footage (vehicles, number plates, bystanders, etc.) are incidental or you have the lawful right to include them. You must not distribute another person's personal information of any kind without their express permission.
- The Footage is accurate and does not violate any applicable law.
- You also permit any other user to access, view, store or reproduce the Footage for that user's personal use. You acknowledge that your use or reliance upon any user submission posted on the Platform is at your own risk.
- you will not submit anything on the Platform through the Footage that is illegal or encourages or advocates illegal activity or conspiracy to commit any criminal activity.
You are solely responsible for ensuring compliance with all laws applicable to your submission. We cannot and do not assure that other users are or will be complying with the foregoing. You acknowledge and agree to assume all risk of harm or injury resulting from any such lack of compliance.
- Privacy and Personal Information
6.1 Types of Personal Information Collected
By submitting the Footage, you acknowledge that the Footage and related submission may contain personal information, including but not limited to:
(a) video images and audio recordings;
(b) images of individuals, vehicles, license plates, or other identifiable features captured incidentally;
(c) any personal information you provide at the time of submission, such as your name or email address.
6.2 Purposes of Collection and Use
MiTAC may collect, use, store, and process the above personal information solely for the following purposes:
(a) reviewing, assessing, selecting, and managing the submitted Footage;
(b)publishing and using selected Footage for marketing, promotional, educational, and public awareness purposes, including promoting road safety and showcasing content captured using MiTAC dash cameras, through MiTAC’s websites, social media channels, and other marketing platforms, in accordance with these Terms;
(c) communicating with you in relation to your Footage submission, including administration, selection, or notification relating to potential promotional use of the Footage. Where you separately provide your opt-in consent to receive marketing or product information from MiTAC, MiTAC may also use your personal information (such as your email address) to send marketing communications or newsletters about MiTAC products or services. You may withdraw your consent at any time by contacting us or by using the unsubscribe mechanism included in such communications.;
(d) for internal research and development purposes so as to build better products and services for customers, including you; and
(e) protecting MiTAC’s legal rights and complying with applicable laws, regulations, or lawful requests.
6.3 Data Retention
MiTAC will retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected, unless a longer retention period is required or permitted by law. Once the relevant purpose no longer exists, the personal information will be deleted, destroyed, or de-identified in accordance with applicable law. If in the future we intend to process your personal data for a purpose other than that which it was collected, we will notify you of that purpose together with any other relevant information.
6.4 Disclosure and Processing
MiTAC may store or process personal information either internally or through third-party service providers, including cloud hosting providers used for the submission and management of Footage.
MiTAC will take reasonable steps to ensure that any third-party service providers engaged handle personal information in accordance with applicable privacy laws.
6.5 MiTAC may disclose personal information where required or permitted by law, including where such disclosure is necessary to:
(a) comply with a subpoena, court order, legal process, or other legal obligation;
(b) enforce these Terms or any other applicable terms, policies, or agreements; or
(c) establish, exercise, or defend MiTAC’s legal rights.
6.6 MiTAC may transfer or disclose personal information to an affiliate or third party in connection with any actual or proposed reorganisation, merger, sale, joint venture, assignment, transfer, or other disposition of all or part of MiTAC’s business, assets, or shares, including in connection with insolvency or similar proceedings.
Any recipient of such personal information will be required to handle the information in a manner consistent with applicable privacy laws.
6.7 Your Rights
You may request access to, or correction of, your personal information held by MiTAC in accordance with applicable privacy laws.
You may request the deletion or de-identification of your personal information. MiTAC will take reasonable steps to delete or de-identify such information where it is no longer reasonably necessary for the purposes for which it was collected, unless retention is required or permitted by applicable law.
Where MiTAC processes personal information based on your consent, you may withdraw that consent at any time. Withdrawal of consent will not affect any lawful processing carried out prior to withdrawal.
If you have a concern about how MiTAC handles your personal information, you may contact us. You may also have the right to lodge a complaint with a relevant privacy regulator or a court, in accordance with applicable law.
6.8 Children's Privacy
We encourage parents and guardians to take an active role in their children's online activities.
MiTAC does not knowingly collect personal information from individuals who do not have the legal capacity to provide valid consent without appropriate parental or guardian consent.
If you believe that MiTAC may have collected personal information from a child without proper consent, please contact us using the methods provided below, and we will take prompt measures to investigate and address the matter in accordance with applicable Australian privacy laws.
6.9 Security of Your Personal Information
MiTAC is committed to protecting the information you provide us. We take the information and platform security very seriously and we strive to comply with our obligations at all times. MiTAC will take great care in maintaining the security of your personal data and in preventing unauthorized access to it through the use of appropriate technology and internal safeguards. Your information is protected by controls designed to minimize loss or damage through accident, negligence or deliberate actions.
6.10 Privacy Policy
MiTAC’s Website Privacy Policy and Website Terms of Use form part of these Terms and are incorporated by reference. In the event of any inconsistency, these Terms shall prevail to the extent of the submission and use of Footage.
- Prohibited Content
You must not upload Footage that contains:
- unlawful acts;
- dangerous, reckless, or unsafe behaviour;
- graphic, offensive, or inappropriate material;
- personal information of minors without lawful authority;
- material that breaches privacy, road safety laws, or third-party rights.
MiTAC may reject or delete any submission at its discretion.
- No Compensation
You acknowledge and agree that:
- You will receive no payment, reward, compensation, or benefit for submitting or permitting MiTAC to use the Footage.
- MiTAC has sole discretion as to whether, how, or when Footage is used.
- Your submission may make you eligible to participate in promotional activities administered separately by MiTAC. Any promotions, giveaways or prizes are governed by their own Promotion Terms & Conditions..
- Withdrawal of Consent
You may request that MiTAC cease using your Footage or remove your personal information. However, you acknowledge that MiTAC may not be able to withdraw or retract Footage that has already been published, distributed, or relied upon under the license granted.

- Liability and Disclaimers
To the maximum extent permitted by applicable law, MiTAC is not liable for:
- failures, delays, corruption, or loss of data during upload or transmission;
- any loss or damage arising from your submission;
- use or publication of Footage as authorised by you;
- third-party copying, sharing, or redistribution of published Footage;
- issues arising from third-party hosting, ISPs, telecommunications providers, or systems not controlled by MiTAC;
- any misuse of the Footage by you or by third parties outside MiTAC’s control;
- verifying whether the Footage complies with laws or third-party rights — you bear full responsibility for such compliance.
MiTAC disclaims all liability for direct, indirect, incidental, consequential, special, or exemplary damages arising from your submission.
- No Warranty
The Platform is provided “as is” and “as available”.
MiTAC makes no warranty regarding:
- accuracy, completeness, or reliability of the Platform;
- uninterrupted or error-free operation;
- suitability of the Platform for any particular purpose.
- No Guarantee of Storage
MiTAC does not guarantee storage, backup, continued availability, or long-term retention of Footage. Footage may be deleted or archived at any time without notice.
- Right to Decline or Remove Content
MiTAC may refuse, remove, or delete any Footage for any reason, including:
- breach of these Terms;
- legal or rights concerns;
- offensive or unsafe content.
- User Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless MiTAC and its affiliates, directors, and employees from all claims, damages, and losses arising from:
- your breach of these Terms;
- third-party claims relating to the Footage (privacy, IPR, defamation, etc.);
- your failure to obtain necessary consents;
- unlawful or improper recording or submission of Footage.
- Governing Law
- For Users in Australia: these Terms are governed by the laws of New South Wales, Australia.
- For Users in New Zealand: these Terms are governed by the laws of New Zealand.
- Agreement
By uploading the Footage via www.navman.com.au /video-upload or www.navman.co.nz/video-upload, you confirm that:
- You have the authority to submit the Footage;
- You have read and understood these Terms;
- You agree to be bound by these Terms;
- You grant MiTAC the license described in Article 4.
